Procedure: The property will be offered in 3 individual tracts, or any combination of tracts.. Bids on tracts and tract combinations may compete, and there will be open bidding on tracts and combinations during the auction. The final bids, resulting with the highest sale price, will be presented to the Seller.
Down Payment: 10% down payment on the day of the auction with the balance in cash at closing. The down payment may be in the form of cash, cashier’s check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
Acceptance Of Bid Prices: Successful bidder will be required to enter Purchase Agreement at the auction site immediately following the close of the auction. Final bid price is subject to the Seller’s acceptance or rejection.
Evidence Of Title: Seller shall provide an Owner’s Title Insurance Policy in the amount of the purchase price.
Deed: Seller shall provide a Warranty Deed.
Closing: The balance of the purchase price is due at closing, which will take place 30 days after auction date, or as soon thereafter as applicable closing documents are completed. Seller and Buyer(s) shall share 50:50 in closing cost charged by Title Company.
Possession: Possession shall be given at closing on all tracts except for the house and buildings which shall be given within 30 days of close.
Mineral Rights: Sale shall include all of the mineral, oil and gas rights owned by the Seller.
Real Estate Taxes & Assessments: Seller shall be responsible for taxes and assessments billed before day of closing and Buyer(s) to be responsible for taxes and assessments billed the day of closing and thereafter.
Land Division Approvals: Proposed land divisions have been discussed with Tompkins Township and conceptually approved. Sale of property which involves newly created parcels, is subject to approval (per Section 108 of Land Division Act) from the Township. Upon completion of the auction, which will determine any successful combination bids, final surveyed descriptions will be submitted to the Township for the completion of their review and approval process.
Acreage: All acreages, dimensions and boundaries are estimations and have been determined based on the legal description.
Easements: Sale of property is subject to any and all easements of record.
Survey: AT THE SELLER’S OPTION, the Seller shall provide a new survey for any parcel where there is no existing legal description or where new boundaries are created by tract Divisions. If a new survey is determined to be necessary by the Seller, the cost of the survey is to be shared 50:50 between Buyer(s) and Seller. Any purchase made in combination will receive a perimeter survey only.
Agency: Brokerage Land Co. and its representatives are Exclusive Agents of the Seller.
Buyer’s Premium: A Buyer’s premium of 3% of successful bid will be due from Buyer at closing. Please take this into consideration when bidding.
